Terms of Service

By accessing and using Kushtunes (“the Service”), you accept and agree to be bound by the terms of this agreement. If you don't agree, please don't use the Service.

Kushtunes provides music distribution services, letting artists upload, distribute, and monetize their music across digital platforms including but not limited to Spotify, Apple Music, Amazon Music, YouTube Music, and other streaming services.

To use our Service you must create an account. You're responsible for keeping your account and password confidential, and for all activity under your account.

• You must provide accurate and complete information
• You must be at least 18 years old to create an account
• You must complete KYC (Know Your Customer) verification
• You're responsible for all content uploaded to your account

You retain all rights to your original musical content. By uploading content, you grant us a non-exclusive license to distribute it through our partner platforms.

4.1 Content requirements

• All content must be original or properly licensed
• No copyrighted material without permission
• No hate speech, violence, or illegal content
• Audio files must be in WAV or FLAC format
• Cover art must be 3000×3000 pixels, JPG or PNG format

By submitting content for distribution, you agree that:

• We will distribute your content to selected platforms
• Distribution may take 7–14 days for processing
• Platforms may reject content that violates their policies
• You're responsible for ensuring content compliance
• We reserve the right to remove content that violates our policies

We accept payments through various payment gateways and processors. All payments are processed securely through our payment partners.

6.1 Payment methods

We accept payments through trusted payment gateway providers. We're integrating additional payment processors to expand options and support more regions and currencies. When new partners are integrated, we'll update these Terms.

Payment processing: all transactions are processed securely by our payment partners. We don't store your full payment card details. Payment information is encrypted and transmitted under PCI DSS compliance standards.

6.2 Event ticket purchases

• All ticket purchases are final once payment is confirmed
• Tickets are non-transferable unless explicitly stated otherwise
• Event organizers may set their own refund policies for their events
• We act as a payment processor and ticket distribution platform

6.2.1 Event ticket pricing and fees

Customer pricing: when purchasing event tickets, customers pay the ticket price plus transaction fees charged by our payment processor (PesaPal). Platform commission is NOT added to the customer's total.

• Transaction fees: payment processing fees (typically 1.5% – 2.75% + fixed fee depending on payment method) are charged by PesaPal and added to your total at checkout.
• Platform commission: KushTunes charges event organizers an 8% commission on ticket sales. It's deducted from the organizer's payment after successful ticket sales, not added to customer prices.
• Organizer earnings: event organizers receive 92% of ticket sales (ticket price minus 8% platform commission). Transaction fees are separate and paid by customers.

6.3 Refund policy

Refund eligibility and processing depend on the type of service and the specific circumstances:

• Event tickets: refunds are subject to the event organizer's refund policy. If an event is cancelled, postponed, or significantly modified, refunds will be processed according to the organizer's terms. Contact the organizer or our support team for refund requests.
• Music distribution: once music has been submitted and accepted for distribution, refunds are generally not available. If distribution fails due to technical issues on our end, we'll work to resolve or provide appropriate compensation.
• Processing fees: payment processing fees charged by our payment partners are non-refundable, even if a refund is granted for the underlying service.
• Refund processing time: approved refunds are processed within 5–10 business days, depending on the payment method and our payment partner's processing times. Refunds are issued to the original payment method.

6.4 Cancellation policy

• Event cancellations: if an event is cancelled by the organizer, ticket holders will be notified and refunds will be processed according to the organizer's cancellation policy.
• Account cancellation: you may cancel your account at any time. Upon cancellation, your account will be deactivated and your data will be retained according to our Privacy Policy.
• Service cancellation: to cancel an ongoing service subscription, do so before the next billing cycle to avoid charges.

6.5 Revenue and royalties (for artists)

Revenue from streaming and downloads is collected by our partner platforms and distributed according to the following terms:

• Revenue reports are provided monthly
• Minimum payout threshold: $25
• Payouts are processed within 30 days of request
• All payments are subject to applicable taxes
• We take an 8% commission on ticket sales (deducted from organizer payments)
• For event tickets: platform commission (8%) is deducted from your ticket sales. Customers pay ticket price + transaction fees only.

You may not use our Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, state, or local regulations, rules, laws, or ordinances
• To infringe our intellectual property or the IP rights of others
• To harass, abuse, insult, harm, defame, slander, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason — including breach of these Terms.

The information on this Service is provided on an “as is” basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions, and terms relating to our Service and the use of this Service.

In no event shall Kushtunes, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation loss of profits, data, use, goodwill, or other intangible losses — resulting from your use of the Service.

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We work with trusted payment partners and service providers. We're integrating additional payment processors, financial services providers, and business partners to enhance and expand our services. These partnerships may evolve over time.

12.1 Current payment processing

We currently process payments through established payment gateway providers. All transactions are processed under PCI DSS compliance. We don't store your full payment card details.

12.2 Future integrations

We may integrate additional payment processors, financial services providers, music distribution platforms, event management services, and other business partners:

• Additional payment gateway providers to support more regions and currencies
• Mobile money payment options for various markets
• Alternative payment methods to provide more flexibility
• Financial services integrations to enhance user experience

When we add new partners or integrations, we'll update these Terms and our Privacy Policy. By using our Service you acknowledge and agree that:

• We may share your information with current and future payment partners and service providers as necessary to process transactions and provide our services
• New payment methods and partners may be added without prior notice, though we will update our Terms and Privacy Policy accordingly
• You're responsible for reviewing and accepting the terms of any new payment partners we integrate
• We are not responsible for the policies, practices, or security measures of third-party payment processors, though we only work with reputable, PCI DSS compliant partners

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we'll provide at least 30 days notice prior to any new terms taking effect. Material changes may include:

• Changes to payment processing methods or partners
• Changes to pricing, fees, or commission structures
• Changes to refund or cancellation policies
• Changes to data sharing practices with partners
• Significant changes to service features or availability

Continued use of our Service after any changes to these Terms constitutes acceptance of the new terms. If you don't agree, you must discontinue use of the Service and may cancel your account.
